Whereas Old Massett Village Council is a band within the meaning of the Indian Act;
Whereas on October 24, 1924, July 24, 1929 and November 3, 1931, Canada acquired, for the use and benefit of Old Massett Village Council, title to the lands described in the attached schedule;
Whereas on July 29, 1938, by way of British Columbia Order in Council 1036, British Columbia transferred to Canada administration and control of certain British Columbia Crown lands which surround the lands, thereby setting them apart for the use and benefit of Old Massett Village Council as Masset Indian Reserve No. 1;
Whereas since July 29, 1938, Old Massett Village Council has always occupied the lands and Canada has consistently treated the lands as reserve lands and has administered them in accordance with the Indian Act;
And whereas, since there is no known formal record to confirm that the lands were set apart for the use and benefit of Old Massett Village Council, Canada wishes to establish a clear record and to confirm the status of the lands since July 29, 1938;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, confirms that the lands described in the attached schedule, consisting of about 8.48 hectares (20.95 acres), have been set apart for the use and benefit of Old Massett Village Council as part of Masset Indian Reserve No. 1 in British Columbia, since July 29, 1938, and continue to be set apart for Old Massett Village Council for that purpose.
